Does DPI Forestry support the false belief of 'terra nullius'

Mr David West, A/General Manager of Marketing, DPI Forestry, states in his letter below:
"the pine trees subject to your proposed activities are the absolute property of the Crown"
Mr West is referring to the pine plantation growing in the Toolara Forest, which is on Dalungbara Aboriginal property.
Mr West is supporting the concept of 'terra nullius' (‘land belonging to no one’) when he uses the terminology "absolute property of the Crown".
