The Queensland Government's recognition of traditional ownership was a condition of World Heritage Listing by the U.N. The Queensland Gov't acknowledged that possessory and Aboriginal titles were never extinguished. See bottom of page.

racist and unacceptable situation at Fraser Island remedied.

OUR PROPERTY RIGHTS TO FRASER ISLAND
We were in occupation and possession of our lands, waters and seas of Fraser Island when British Sovereignty was declared, making us British subjects, and hence entitled to Possessory Tenure under Common Law.

This legal fact is the basis for the listing of Fraser Island for World Heritage by the United Nations World Heritage Commission.
The Queensland Parks & Wildlife Service manage our property as Trustees, not the owners.
We are taking the initiative to run our own tourism and cultural activities as recommended by the Management Plan submitted to the United Nations.
We have been most frustrated by our trustee, the Queensland Parks & Wildlife Service, preventing us from fulfilling our aspirations for our island.

THE QUEENSLAND GOVERNMENT SUMISSION TO THE UNESCO WORLD HERITAGE CONVENTION
Commission of Inquiry into the Conservation, Management & Use of Fraser Island & the Great Sandy Region, Supplementary Volume, Vol 1: Part 1, May 1991 Appendix 3, page 78 Conclusion, reads in part:

" The legal entitlements to the land at Fraser Island and the Great Sandy Region were never voluntarily surrendered by the Aboriginal people. No legislation has been passed extinguishing their possessory or Aboriginal title, with the possible exception of legislation granting fee simple title. In any event the statute of limitations may prevent Aboriginal claimants pursuing those who hold fee simple title. However, the Crown cannot maintain a defence using the Statute of Limitations against the Aboriginal people in relation to Crown land as such a defence is not available to a trustee against its beneficiaries. "

TERRA NULLIUS . . . . . . . . . . What was terra nullius?
Statement by Justice Brennan of the High Court of Australia.
" Terra nullius is a Latin term meaning 'land belonging to no one'. When colonising Australia, the British Government used this term to justify the dispossession of Indigenous people. The British colonists did not recognise the land was being used as Indigenous people did not use the land in the same way as the British. The British saw no evidence of agricultural, social or religious structure like their own, and therefore incorrectly concluded that Indigenous people did not own the land but simply roamed it. By using the principle of terra nullius, the British Government claimed sovereignty over Australia, ignoring the rights of Indigenous people who had lived there for at least 60 000 years.
The commonon law of this country would perpetuate injustice if it were to continue to embrace the notion of terra nullius and persist in characterising the Indigenous inhabitants of the Australian colonies as people too low in the scale of social organisation to be acknowledged as possessing rights and interests in land. "
