The following terms and conditions shall apply:

Adopter agrees to be legally, morally and financially responsible for Brumby and proper care of Brumby as described by BWA (see appendix).

Adopter agrees to be responsible for any personal injury, property damage, or death caused by Brumby in their care, for pursuing Brumby that escapes or strays, and for costs of recapture.

Adopter shall not maliciously nor negligently injure Brumby, or cause Brumby to be injured. Should serious accidental injury or illness occur, Adopter agrees to have a veterinarian treat Brumby and shall be responsible for all veterinarian fees.

Adopter shall not treat Brumby inhumanely, or use aggressive coercion techniques.

Adopter shall not destroy Brumby, or have Brumby destroyed, except as an act of mercy, and under the attention and advice of a veterinarian, in which case with all possible attempts to save the horse, Brumby Watch Australia must be notified where possible of an incidence occurring.

Adopter shall notify BWA immediately of discovery of adopted Brumby's death, theft or escape.
In the case of Brumby's death, Adopter shall dispose of remains in accordance with applicable sanitation laws.

Adopter shall not sell, loan or transfer Brumby to any other party or location without prior written approval of BWA. Adopter shall agree to four (4) assessments during the year.

Adopter shall agree that in the case of adopting a Stallion that the said stallion shall be gelded and a copy of veterinary procedure be produced to BWA within six weeks of Delivery of Brumby into the Adopter's care.

Adopter shall not use Brumby in the sport of buckjumping.

All right, title, and ownership of Brumby or any of its progeny, shall remain the property of BWA for the first year of adoption. Adopter can request title to Brumby after one year if they have demonstrated proper care for the adopted Brumby during that time. There are no additional costs when obtaining title.

Adopter agrees to notify BWA immediately if they can no longer care for Brumby, at which time arrangements will be made to relocate Brumby through our programme. Adopter is to maintain financial responsibility of Brumby until another adoption is in place.

Adopter agrees, that under no circumstances will Brumby be sold or transferred to any slaughterhouse, or person who sells animals to slaughterhouses (including public auctions). Adopter understands that should Brumby be sold or transferred to auction, feed lot, slaughterhouse, or any slaughterhouse representatives or dealers, Brumby will be considered and reported as stolen property and all parties involved will be prosecuted.

Adopter agrees that BWA has the right to physically inspect Brumby and Adopter's animal facilities from time to time.
Where practical we recognise that time may be the answer to a problem rather than removal, in this case the Adopter shall receive written notification of problems to be corrected and a two week time period given to rectify problems, and a reassessment evaluated.

BWA shall remove Brumby from Adopter's care immediately, if Brumby is found neglected, or upon termination of an agreement where notification and all possible attempts have been made to correct a problem.

Adopter agrees to arrange transport of the adopted Brumby and the Adopter agrees to pay transporting costs.

Adopter agrees that suitable housing and fencing shall be supplied for Brumby upon acceptance of adoption.

Fencing and housing is to be in compliance with recommendation by BWA, subject to approval.

An adoption fee applies.

Appendix

Adopter must be over 18 years of age:

Care of Adopted Brumby:
Because of the nature of Brumby to be adopted, BWA has a preferred management programme for the proper care and maintenance of Brumby.
Adopter must understand that they are adopting a wild horse, an animal that has previously known no fences or boundaries, no restrictions what so ever. The Brumby is unlike any 'domestic' horse that has lived it's whole life among humans, it is an animal that must now adjust to domesticated life and captivity.

Living Conditions:
A minimum of two acres is required.
A companion horse is required.
Brumby must have access to some sort of shelter. Adequate fencing is to be provided.
Brumby should have access to clean fresh water at all times.
Feeding:-
New feeds are to be introduced carefully and gradually, ensuring that the bulk of the diet consists of roughage, usually over at least a two week time period, so as to not cause colic and other dietary ailments.
Health:-
Worming should be carried out. A commercial equine wormer can be used. This can be a commercial wormer in the form of a paste, pellet, or liquid. Worming can also be done through the use of natural methods.
If required, teeth are to be cared for by either a Veterinarian or Farrier.
BWA also requires immunisation for Tetanus & Strangles.
Training:-
Adopter shall as much as possible train Brumby according to natural horsemanship practices.
Hoof Care:-
It is Adopter's responsibility to ensure good hoof care is undertaken, whether this is by a recognised farrier or by natural hoof care.
Breeding:-
It should be understood by Adopter that under no conditions is the adopted Brumby to be used for breeding purposes, unless permission is granted by BWA. The process of domesticating the Brumby is to ensure that fewer future cullings take place. There are more than adequate Brumbies available for adoption purposes should the applicant desire more. Those that will be left in the wild will more than adequately provide future progeny for adoptions. This will assist in reducing the problem of over breeding which exists within the horse industry.
Any foal/s born to the Brumby during the adoption period will be property of BWA.
Should Adopter wish to keep the foal/s at the end of the Brumby's adoption period, Adopter can request title to the foal/s at the same time as requesting title to the Brumby. There will be no cost for the foal/s.
Should Adopter not wish to keep the foal/s at the end of the Brumby's adoption period, Adopter will forward the foal/s to BWA after weening the foal/s.

Fostering
Information on fostering a brumby:
Fostering involves the temporary housing, care and maintenance of a brumby until a permanent home can be found through our adoption programme.
There are no fees involved.
The same conditions apply for the welfare of the Brumby as for Adoptions.
